The appeal filed by Ethem Sarısülük’s family and their lawyers for concerning Ethem’s murderer’s going scot free has been rejected by the court, arguing that the family has no right of opposition.
The court rejected the appeal filed by Ethem Sarısülük’s family, he who got murdered by a police bullet on the 1st of June in Kızılay Square during the “June Resistance”, for the police officer Ahmet Şahbaz’s going scot free.
The court regarded Şahbaz’s diving into crowd in the square and kicking the protestors, then aiming at Ethem and shooting him in the head as an act of self defense and the prosecutor did not raise any objection.
According to the Radikal author Mesut Hasan Benli’s report, the family’s lawyers have expressed opposition to court’s decision.
Ankara 8th Criminal Court of First Instance, having considered the opposition, rejected the request, on the grounds that “the family has no right of opposition”. It has been indicated by the court that in the event of decision of refusal the rights of the injured party and collectives are apparent and that they do not have the right to oppose to the decision of release, remarking that only the public prosecutors could oppose to the release.
“We, as the lawyers of the family, are a party to the legal proceedings. The decision made is against the principle of equity of arms. There isn’t exist any clear statement in the legislation remarking we don’t have authorization,” responds one of the lawyers of the family, Eylem Hakverdi.
Murderer Police Officer has been Scotched
Meanwhile the statements of the Deputy Prime Minister Bülent Arınç and the master of the supreme court who released the police officer, indicating that the mentioned police officer had been injured due to protestors’ throwing rocks.
The medical report shows that the police officer had elbow, ankle and hand injuries, indicating that these injuries can be easily treated using “basic medical response”.
